Railroad Trespass

Milan police received a call from an employee of Norfolk Southern Railroad at about 2:10 p.m. Jan. 20 that three apparent juveniles were walking east along the railroad tracks near the intersection of Wabash and Allen roads. The employee told police he had seen the same juveniles on the tracks before and had warned them to stay off of them.
An officer saw the juveniles walking along the tracks, then turn into Wilson Park after seeing the police car. The officer talked with the juveniles and recognized two of them by previous contact. He had warned them before that it was illegal to walk on the tracks.
They admitted that they knew walking on the tracks was illegal, and were taken into custody and later.
Drunken Driving
A Milan officer on patrol Jan. 19 saw a man walking southbound along Wabash Street at about 2:40 a.m. The man appeared to be intoxicated. As he walked into the parking lot of the American Legion Hall, he held onto a nearby fence to remain upright. The officer approached the man as he opened the driver's side door and appeared to be preparing to leave.
The officer told the man that he appeared to be too intoxicated to drive and asked for his identification. After checking his pockets and inside the vehicle, the man said he could not locate his wallet. He gave the officer his name, date of birth and address, using slurred speech, according to a police report.
The officer warned the man that he needed to call someone else for a ride and that if he attempted to drive out of the parking lot, he would be arrested for operating a vehicle while intoxicated. He told the officer he would call for a ride and not drive the vehicle.
The officer left the man standing next to the vehicle and parked his patrol car across the street, where he could watch. About two minutes later, the man entered the driver's side door and started the vehicle. He then drove over the curb out of the parking lot and down Wabash Street without turning on his headlights.
The vehicle was pulled over and the driver was given a Breathalyzer test, which showed a blood-alcohol level of 0.23 percent, which is more than twice the legal limit of 0.08 percent. He was arrested and lodged at Milan Police Department until sober.
Attempted Fraud
Two officers were dispatched to a restaurant on Dexter Street at 6 p.m. Jan. 19 after a report of attempted fraud. A woman had asked the cashier for two $20 bills in exchange for two $10 bills and four $5 bills. The cashier made the change and, as the woman began to leave, she turned with a $20 bill and a $1 bill and told the cashier she had accidentally been handed those bills instead of the two $20s.
The cashier asked her manager to check the cash register to see if a mistake had been made. The woman responded by saying she needed to talk to her husband and left the store, at which point the police were notified.
